Supreme Court Orders Imran Khan’s Transfer to Shifa Hospital

The Supreme Court has ordered the transfer of PTI founder Imran Khan to Shifa Hospital.A three-member Supreme Court bench, headed by Justice Shahid Waheed and comprising Justice Naeem Akhtar Afghan and Justice Ishtiaq Ibrahim, heard a case concerning Imran Khan’s health and meetings with his family members.

PTI Assurance

The court also obtained an assurance from Pakistan Tehreek-e-Insaf (PTI) that there would be no politicization of Imran Khan’s medical reports and that no crowds would gather outside the hospital.

During the hearing, Justice Shahid Waheed asked which of Imran Khan’s sisters should be allowed to meet him. The lawyer replied that Uzma Khan should be allowed to meet him because she is a doctor.

Regarding Imran Khan’s transfer to a private hospital, lawyer Uzair Bhandari said that the government had previously taken him to PIMS several times, raising the question of who would bear the expenses of a private hospital. Uzma Khan’s lawyer said that the family would bear the private hospital expenses themselves.

Medical Reports

Justice Shahid Waheed asked who would guarantee that Imran Khan’s medical reports would not be made public or used for political purposes. Salman Akram Raja replied that the political party would not use the medical reports for political purposes, adding that the reports were a matter between the doctors, Imran Khan and his family.

Justice Naeem Afghan asked what guarantee there was that a crowd would not gather outside the hospital. He observed that other patients would also be present and should not be disturbed. A PTI representative assured the court that the party had different political principles and would not politicize Imran Khan’s health.

Earlier, the court had sought all of Imran Khan’s medical reports, details of meetings held with him over the past three years, and records concerning telephone conversations between him and his children.

Justice Shahid Waheed remarked that once the medical record was submitted to the court, it would no longer remain confidential. Justice Naeem Afghan told the parties that there should be no politics over Imran Khan’s health.

Justice Shahid Waheed questioned why there was any issue with providing Imran Khan’s complete medical record. He noted that the material submitted to the court consisted only of a summary of the medical report and directed that the complete record be submitted.

Imran Khan meetings

The judge also asked about meetings between Imran Khan and his sisters. The Advocate General for Islamabad said that no meeting would be allowed if anyone violated the law.

Justice Shahid Waheed responded that if someone was violating the law, the state should not violate it either. He remarked that meetings with the sisters were not a favor but a fundamental right.

Justice Shahid Waheed further observed that it was not the state’s job to violate the law and questioned why the directions of the Islamabad High Court were not being implemented.

The Advocate General for Islamabad told the court that Imran Khan’s sisters had been allowed 48 meetings with him over the past three years.

Lawyer Uzair Bhandari told the court that Imran Khan’s sisters should be allowed to meet him and assured the court that they would not speak to the media.

Justice Naeem Afghan said that one thing should be settled: there should be no politics over the PTI founder’s health.

The Supreme Court subsequently sought complete details of the meetings between Imran Khan and his sisters, as well as records of all meetings and telephone conversations between the PTI founder and his children.
