Emergency vs Governor’s Rule: What Does Pakistan’s Constitution Allow in KPK

Emergency and Governor’s Rule are separate constitutional mechanisms in Pakistan, with different grounds, procedures and implications for a provincial government and assembly.

Urdu Report Desk

Pakistan’s Constitution provides different mechanisms for dealing with extraordinary situations in a province, including a proclamation of emergency and what is commonly described as Governor’s Rule. However, the two measures are constitutionally distinct and are triggered by different circumstances.

Emergency Under Article 232

Article 232 deals with the proclamation of emergency when the security of Pakistan or any part of it is threatened by war, external aggression or internal disturbance beyond the power of a provincial government to control.

Under the current constitutional text, an emergency based on such internal disturbance requires a resolution from the concerned Provincial Assembly. If the President acts on his own, the proclamation must be placed before both Houses of Parliament for approval within 10 days.

What Happens During an Emergency?

Once an emergency is in force, Parliament can acquire the power to legislate for a province on matters that are otherwise within the provincial sphere.

The Constitution also allows the Federal Government to issue directions to a provincial government regarding the exercise of its executive authority. In certain circumstances, the Federal Government may assume some or all functions of the provincial government or direct the provincial governor to exercise those functions on behalf of the Federal Government.

What Is Governor’s Rule?

The measure commonly referred to as Governor’s Rule is constitutionally linked to Article 234, which deals with the failure of constitutional machinery in a province.

Under Article 234, if the President, after receiving a report from the Governor of a province, is satisfied that a situation has arisen in which the provincial government cannot be carried on in accordance with the Constitution, the President may issue a proclamation.

Powers Under Article 234

Under Article 234, the President can assume all or some of the functions of the provincial government or direct the Governor to exercise those functions on behalf of the President.

The President may also declare that the powers of the Provincial Assembly are to be exercised by Parliament or under its authority. However, the constitutional powers of a High Court cannot be assumed or exercised by the President or Governor under this provision.

The Key Difference in Khyber Pakhtunkhwa

In the context of Khyber Pakhtunkhwa, the constitutional distinction is important.

If the issue is primarily serious internal disturbance that is beyond the provincial government’s power to control, the relevant constitutional mechanism is Article 232, subject to its requirements.

If the issue is that the provincial government cannot be carried on in accordance with the Constitution, Article 234 concerning failure of constitutional machinery becomes relevant.

What Challenges Could the Federal Government Face?

The use of either mechanism would involve constitutional procedures and parliamentary requirements. The precise legal route would depend on the grounds cited and the constitutional provision invoked.

Therefore, imposing an emergency does not automatically amount to imposing Governor’s Rule. The two measures have different constitutional grounds, procedures and potential effects on provincial institutions.

In the case of Khyber Pakhtunkhwa, any move toward either mechanism would consequently have to be considered within the specific requirements of Articles 232 and 234 of the Constitution.
